The authorized organization ENVI-PAK will be pleased to help to meet your duties in a convenient, transparent and efficient manner.
The new Packaging Act No. 119/2010 Coll. became effective as of May 1, 2010. Among other things the definition of obliged persons has been amended in the new Act.
Based on the new Packaging Act, an obliged person is a natural person – entrepreneur and a legal entity who:
- Packs or fills its products in packaging,
- Introduces packed products into market,
- Introduces packages into market with the exception of packaging producers and importers who supply empty unused packages to obliged persons under 1).
Based on the new Act definition, an obliged person comprises: persons packing/filling products in packages, importers of packed products and importers/producers of empty packages introduced directly into market (into the distribution chain):
- A producer of empty packages becomes an obliged person if the packages are introduced to the end consumers in the distribution chain directly or indirectly through other suppliers.
- An importer of empty packages to Slovakia is no longer an obliged person if the packages are imported and introduced to producers who pack/fill their products in the packages.
An obliged person is obliged to meet its regulatory duties under the Packaging Act, mainly to ensure packaging waste collection, recovery and recycling at least in the extent of the binding recovery and recycling limits.
The packaging Act enables any obliged person to meet its duties via a so-called authorized organization.
ENVI-PAK became THE FIRST AUTHORIZED ORGANIZATION under Art. 8 Par. 2 of the Packaging Act. ENVI-PAK was registered in the Register of Obliged Persons and Authorized Organizations of the Slovak Ministry for the Environment under the sequence number OO_0000001 in August 2004.
