How to legally use the GREEN DOT registered trademark
The GREEN DOT registered trademark may be legally used in Slovakia only by companies that entered into a license agreement with ENVI-PAK, the holder of the exclusive right to use the GREEN DOT registered trademark and that participate in the development of the GREEN DOT system, the main objective of which is to promote separate waste collection and awareness raising among the general public.
There are two options for anyone who wants to place the GREEN DOT registered trademark on the packaging of its products introduced in the Slovak market:
1. To enter into a license agreement with ENVI-PAK based on a Contract on Cooperation that includes comprehensive services in the field of compliance with its duties in relation to the Packaging Act and also some services in relation to the Waste Act. The Contract on Cooperation comprises the granting of a license to use the GREEN DOT registered trademark on the packaging of its products. The consideration (fee) for the use of the GREEN DOT registered trademark is charged in line with the up-to-date price list of ENVI-PAK.
The Contract on Cooperation comprises comprehensive services including:
- compliance with duties under Act No. 119/2010 Coll. on packaging,
- support with professional know-how and expertise,
- support in the field of Client advocacy.
2. To enter into a License Agreement on the use of the GREEN DOT registered trademark. If your Company prefers a different form of cooperation, ENVI-PAK provides you with the option to customize the agreement and conditions of use of the GREEN DOT registered trademark on the packaging of your products introduced in the market in the territory of the Slovak Republic by entering into a License Agreement on the use of the GREEN DOT registered trademark.
Basic conditions governing the granting of a license to use the GREEN DOT registered trademark:
The entity requesting the granting of a license to use the GREEN DOT registered trademark must meet the following basic requirements in order to be granted the license:
- be an obliged person under Art. 2 g) of the Act No. 119/2010 Coll. on packaging and to be registered under its Art. 9;
- be able to prove compliance with its duties under the national packaging legislation (mainly in relation to its compliance with recovery and recycling limits at least in the extent of the binding limits under the Slovak Government Ordinance No. 220/200), keep records in line with the requirements of the Packaging Act, inform consumers about the manner in which packaging waste is collected and meet its duties pursuant to Art. 8 Par. 4 of the above Act);
- meet conditions of use of the registered trademark in line with the intellectual property rights;
- use only the approved image of the “GREEN DOT” registered trademark;
- pay the quarterly consideration (fee)of € 0.00281/kg of packaging for the use of the “GREEN DOT” registered trademark that is due on a quarterly basis;
- provide truthful and complete information on the use of the “GREEN DOT” registered trademark to the license holder for the territory of the Slovak Republic – the authorized organization ENVI-PAK.
